These terms are between you and HaloAuras LLC, California, United States, which operates PR3TTY P1CKS. Contact: jacquie@haloauras.com. Using the service means these terms apply to you. If you do not accept them, do not use it.

PR3TTY P1CKS is a song request queue for live streamers, made up of a web application, an on-stream overlay, and a small program that runs on your own computer.

It is in early access. Features change and sometimes disappear. Things break. There is no service level agreement, no guaranteed uptime, and no promise that any particular feature will continue to exist. If reliability is critical to you, do not depend on this alone.

You sign in with Google and you are responsible for what happens under your account. You must be at least 13, and old enough to enter an agreement where you live. One account is for one person; do not share sign-in access. If you add moderators, you are responsible for choosing them.

The service helps you search third-party catalogues and place files into a folder on your own computer. Those catalogues are run by other people and are not affiliated with HaloAuras LLC. What you download, whether you may lawfully hold it, and what you do with it afterwards are your responsibility.

Streaming music carries its own rules. Twitch, TikTok, YouTube and every other platform have their own music policies, and copyright law applies to you regardless of what any software does. Nothing here grants you any right to play, perform or broadcast any recording, and nothing here is legal advice.

If you are a rights holder and believe something reachable through this service infringes your rights, email the address above and it will be looked at promptly. Note that files are not stored here; the service points at other people's catalogues.

The service connects to Twitch and TikTok, and may connect to others later. Those companies control their own systems and can change or withdraw access at any time, without notice and without our involvement. When that happens, parts of the service may stop working until they are rebuilt.

You are also bound by those platforms' own terms. Nothing here overrides them.

Viewers who request songs never agreed to anything. Their information is handled as described in the privacy policy, and there are things you should know as the streamer:

• Showing requester names on your overlay is your choice and it is off by default. Turning it on publishes those display names to everyone watching.
• Being listed in the live directory is your choice and it is off by default.
• If a viewer asks for their information to be deleted, that request will be honoured, and it may remove history from your queue.

• Use it to harass, threaten, stalk or target anyone, including through requests, overlays or the tools given to moderators.
• Use it to collect information about viewers for any purpose other than running your own stream.
• Attempt to reach another streamer's data, or to work around the separation between accounts.
• Attack, overload or probe the service, or automate it in ways that degrade it for others.
• Resell it, or present it as your own product.
• Break the law with it, or break the rules of the platforms you stream on.

You choose to install it and you choose which folder it may read. It reads that folder, reports an index of it, and writes downloaded chart files into it. You are responsible for keeping your own machine secure and for having backups of anything you care about. It should not damage anything, and it is your computer, so run it only if you accept that.

You may stop at any time and ask for your account and its data to be deleted. Access may be suspended or ended if these terms are broken, particularly section 7, or if continuing would expose others to harm. Where it is reasonable to warn you first, you will be warned.

The service itself may be discontinued. If that happens you will be given reasonable notice and a way to get your data out.

The service is provided as is and as available, without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. It is not warranted to be uninterrupted, error free, or to match any song correctly.

To the fullest extent the law allows, HaloAuras LLC is not liable for indirect, incidental, special, consequential or punitive damages, nor for lost revenue, lost viewers, lost data, or a stream that went badly. Total liability for any claim relating to the service is limited to the greater of the amount you paid for it in the twelve months before the claim, or fifty United States dollars.

Some jurisdictions do not allow some of these limitations, in which case they apply only as far as the law permits.

Your settings, your library index and your queue history remain yours. Permission is given to store and process them only as needed to run the service for you, as set out in the privacy policy. The software, the name and the design remain the property of HaloAuras LLC.

These terms may change. If a change matters, the date above changes and anyone with an account is told before it takes effect. Continuing to use the service after that means the new terms apply.

These terms are governed by the laws of the State of California, United States, without regard to conflict of laws rules. Disputes go to the state or federal courts in California, and you agree to their jurisdiction. If any part of these terms is unenforceable, the rest still stands.
